Terms and Conditions for YOURTOURKEY (Operated by Aquaventure Tourism)
1. All holidays and offers on this website are subject to the following terms and conditions.
2. YOURTOURKEY is a registered brand operated by Aquaventure Tourism, under ANDRIAKE TOURISM TRADE AND LIMITED COMPANY. Throughout these terms, “YOURTOURKEY,” “we,” or “us” will refer to Aquaventure Tourism, represented by the brand YOURTOURKEY.
3. The purpose of these terms and conditions is to clarify the responsibilities that YOURTOURKEY (Aquaventure Tourism) has toward you, the Client, and any member of your party, as well as the obligations the Client has toward us when a contract is established. We recommend that you carefully read and understand these terms before proceeding with any booking.
4. For clarity within this document, the term “vessel” will be used to refer to any boat, gulet, yacht, or ship. “Product” will refer to any tour, cruise, or holiday package. The term “agent” will refer to our travel agency or any authorized representative.
5. The person whose name appears on the booking contract will be considered the group leader and, therefore, agrees to these terms and conditions on behalf of all persons listed, substituted, or added to the booking form. All individuals listed are deemed to have read, understood, and accepted these booking terms and conditions.
6. All trips listed on the YOURTOURKEY website (kekovatourkey.com), in brochures, or in other promotional materials are organized by YOURTOURKEY, represented by Aquaventure Tourism, which acts as an agent for local service providers. Therefore, your contract is with Aquaventure Tourism, represented by the YOURTOURKEY brand, as an agent of other local providers.
7. All prices displayed on our website are accurate at the time of publishing. Prices may vary due to factors such as seasonal changes or availability. However, once your booking is confirmed, the agreed price will not be affected by any future price changes.
8. Liability of YOURTOURKEY
YOURTOURKEY (operated by Aquaventure Tourism) is not liable for additional costs or losses incurred by the Client due to delays, accidents, or disruptions outside of our control. For services involving transportation by air, sea, or rail and accommodation, our liability will be limited as outlined by relevant international conventions. YOURTOURKEY is not responsible for schedule changes, equipment malfunctions, strikes, theft, baggage loss/damage, or any injury related to accommodation or transportation. The Client is responsible for all such losses or expenses.
9. No-Show Policy
If a Client fails to join a booked product, arrives after departure, or leaves before the product’s completion, no refund will be issued by YOURTOURKEY.
10. Responsibilities of Booking Agents
If you book through an agent, it is the agent’s responsibility to communicate any special requirements you may have to YOURTOURKEY and relay any updates or changes provided by YOURTOURKEY to you.
11. Information and Pricing Policy
Before confirming a booking, YOURTOURKEY reserves the right to adjust prices displayed on brochures, the website, or in-store due to unforeseen circumstances outside of our control, such as governmental actions, increases in transportation costs (including scheduled airfares and fuel costs), changes in taxes, fees for services (including landing fees or embarkation/disembarkation fees at airports), admission fee increases, or exchange rate fluctuations. YOURTOURKEY may modify facilities, transport, services, or itineraries, as well as adjust prices or terms due to these factors without liability for compensation or refund. In such cases, each Client may be required to pay an additional amount reflecting these adjustments.
12. Client Exclusion and Compliance with Local Laws
Clients agree to respect the authority of YOURTOURKEY employees, suppliers, and representatives during the product experience. If, at the discretion of these representatives, a Client’s behavior or health poses a risk to the safety, comfort, or enjoyment of others, YOURTOURKEY reserves the right to exclude the Client from all or part of the product without prior notice or liability. If the Client requires medical assistance, YOURTOURKEY may arrange necessary services at the Client’s expense. Clients are expected to comply with Turkey’s laws and regulations. YOURTOURKEY is not responsible for Clients who engage in illegal or unlawful actions during the product experience.
13. Flight, Ferry, and Bus Intermediary
YOURTOURKEY acts as an intermediary between the Client and external transportation providers (flight, ferry, and bus companies). If these companies make changes such as delays or cancellations, YOURTOURKEY holds no liability. However, YOURTOURKEY will ensure Clients are informed of any changes, delays, or cancellations. In the event of a delay, refunds will not be provided, but in case of a cancellation by the transportation company, refunds will be processed according to the company’s policies. YOURTOURKEY will prioritize the Client’s best interest in all situations.
14. Adventure Activities
YOURTOURKEY can arrange for Clients to participate in adventure activities such as paragliding, diving, or hot air ballooning. As YOURTOURKEY acts solely as a representative agent for these activities, any legal liability resulting from accidents, injuries, or losses falls under the responsibility of the activity provider, and the Client participates at their own risk. YOURTOURKEY ensures reasonable standards and provides essential information about these activities. However, YOURTOURKEY accepts no liability if no fault lies with YOURTOURKEY or its suppliers, or if the damages were caused by the Client’s actions or unusual circumstances beyond OUR control.
15. Travel Documentation
It is the Client’s responsibility to obtain all necessary travel documents, including a valid passport (many countries require validity for six months beyond the stay), an appropriate visa for entry into Turkey, and any required vaccinations or medical certificates. Information about these requirements is provided by YOURTOURKEY in good faith, but without liability. In case of lost or stolen travel documents, YOURTOURKEY may assist, but the Client assumes responsibility for any related costs and is not entitled to reimbursement or compensation.
16. Travel and Health Insurance
Clients are fully responsible for obtaining their own travel and health insurance, which is strongly recommended by YOURTOURKEY. Insurance should cover illness, accidents, baggage loss/damage, theft, cancellations, and repatriation while traveling. YOURTOURKEY shall not be liable for any costs or expenses arising from such incidents during the product. In compliance with Turkish law, all commercial and public-purpose vessels used by YOURTOURKEY carry minimum liability insurance.
17. Health and Fitness Requirements
Before booking, Clients are expected to ensure that they are physically fit to complete the itinerary of their chosen product. Clients with pre-existing medical conditions or illnesses must disclose this information at the time of booking and make necessary arrangements to bring any required medication or treatment. Such Clients must provide a medical certificate from a healthcare provider confirming they are fit to travel. Failure to disclose such information constitutes a breach of these terms, releasing YOURTOURKEY from any obligations or liability. Clients are also responsible for ensuring they have any vaccinations needed for their destinations and must inform YOURTOURKEY of any allergies or health conditions that may impact their experience.
18. Airport Transfers
Airport transfers from any airport in Turkey can be arranged at an additional cost. Full flight details, including arrival time and flight number, must be provided at least two weeks prior to arrival. Incomplete or incorrect information may result in the loss of any refund eligibility for transfers.
19. Free Time
Certain parts of the product may include designated “free time” for Clients to rest, relax, or explore at their leisure. Clients are free to use this time as they wish. YOURTOURKEY accepts no responsibility for any loss, accident, or injury that may occur during these periods of free time.
20. Photography and Media
YOURTOURKEY representatives may take photographs or video recordings of Clients using YOURTOURKEY products. Clients who prefer not to be photographed or recorded should inform the captain or crew. YOURTOURKEY reserves the right to use such media for advertising or promotional purposes without additional consent. Additionally, YOURTOURKEY may use any feedback, comments, or testimonials shared by Clients for promotional materials unless instructed otherwise via email.
21. Personal Data
All Client data is protected under Turkish data protection laws. By agreeing to these terms, Clients consent to the use of their data for purposes such as direct marketing, market research, demographic analysis, and statistical purposes for YOURTOURKEY and its business partners. Clients who wish to opt out of data use for these purposes can notify YOURTOURKEY by email, after which the data will be removed.
22. Acceptance of Terms
Payment of a deposit or final amount signifies that Clients have read, understood, and accepted all terms and conditions stated here and on affiliated websites, and agree to abide by them.
23. Private Yacht Charters
23.1. Confirmation / Deposit Payment for YOURTOURKEY Private Yacht Charters:
Bookings for private yacht charters are only confirmed upon receiving a deposit of 30% to 60% of the total cost, depending on the vessel class. In rare cases, full payment may be required. The exact deposit amount will be confirmed automatically by our online booking system or via email communication. It is the Client’s responsibility to verify that they have received all booking confirmations, tickets, itineraries, and any other relevant details from YOURTOURKEY.
23.2. Balance Payment for YOURTOURKEY Private Yacht Charters:
Payment terms vary by vessel; some charters require pre-payment, while others accept payment upon arrival. These details will be communicated during the booking process.
23.2.a. Bookings with Pre-payment: For bookings requiring pre-payment, the remaining balance must be paid eight weeks prior to arrival, unless otherwise agreed upon with YOURTOURKEY via email. Payment deadlines will be communicated during the booking, and confirmation will be sent via email.
23.2.b. Bookings with Arrival Payment: For bookings that allow payment upon arrival, Clients may choose to pay the balance via card or bank transfer. YOURTOURKEY accepts payment in multiple currencies (EUR, TRY, USD, GBP, CAD, and AUD), with conversions based on xe.com exchange rates.
23.3. Cancellations by Clients:
Clients may cancel their yacht charter contract with YOURTOURKEY at any time. Cancellation becomes effective upon receipt of written notification. Refunds, if applicable, depend on the timing of the cancellation as follows:
More than one year before the product begins: Full refund.
Between 1 year and 180 days before the start date: 70% refund of the charter package.
Between 179 days and 90 days before the start date: 50% refund of the charter package.
Less than 89 days before the start date: No refund.
No refund is given for partially used products or services.
23.4. Cancellation by YOURTOURKEY (Force Majeure):
YOURTOURKEY reserves the right to cancel any confirmed booking under force majeure circumstances, including but not limited to war, civil unrest, labor disputes, terrorist activities, natural disasters, or other events beyond OUR control. In such cases, compensation or refund will not be provided.
23.5. Captain’s Authority and Responsibility:
All passengers must follow vessel rules for safety. Upon embarkation, a safety briefing is conducted by the Captain, who holds the authority to modify the itinerary to ensure the safety of Clients, crew, and the vessel. High-risk activities or water sports are undertaken at the Client’s own risk and must comply with local regulations and crew guidance. The Captain has the authority to end the product early if adverse weather, inappropriate behavior, or medical emergencies arise. Vessel rules are an integral part of these terms and conditions.
23.6. Complaints for Yacht Charter:
In case of any complaints during the yacht charter, Clients should first address concerns to the Captain or crew. If unresolved, complaints can be directed to the YOURTOURKEY office. If issues cannot be resolved on-site, a written complaint with supporting evidence must be submitted to YOURTOURKEY within 30 days of the product’s completion. Complaints submitted after 31 days will not be acknowledged.
23.7. Exclusions:
Additional expenses such as extra beverages, food, fuel for water sports, international port fees, airport taxes, transfers, land tours, visas, personal insurance, and personal items (e.g., internet access, photography fees, medical expenses, excess baggage fees) are not included and are the Client’s responsibility.
23.8. Vessel Capacity:
Each vessel has a specified passenger capacity listed on our website and brochures. Clients must inform YOURTOURKEY of the exact number of passengers upon booking.
23.9. Vessel Engine Failure or Breakdown:
In the event of a vessel breakdown, YOURTOURKEY has 48 hours to resolve the issue by either repairing or replacing the vessel. No refunds will be issued under these circumstances. (For other complaints, see Section 23.6.)
23.10. Unforeseen Changes to Chartered Vessel, Routes, or Ports:
YOURTOURKEY reserves the right to replace or alter the chartered vessel due to unforeseen circumstances, prioritizing Client satisfaction. In such cases, an equal or higher standard vessel will be provided, and transfer costs for any changes in departure or arrival ports will be covered by YOURTOURKEY. No additional charges or refunds will be issued under these conditions.
23.11. Duty of Care:
For private yacht charters, the group leader is responsible for ensuring the care of the vessel’s inventory and equipment. Any damage must be compensated directly to the Captain or vessel operator before the end of the charter, unless otherwise agreed upon.
24. Cabin Cruises
24.1. Confirmation / Deposit Payment for Cabin Cruises:
Cabin cruise bookings are confirmed only upon receiving a deposit. In rare instances, full payment may be required. The deposit amount will be confirmed automatically by our online booking system or by a team member if booked via email. It is also the Client’s responsibility to ensure they have received all relevant booking details, tickets, itineraries, and other information from YOURTOURKEY.
24.2. Payment Procedure for Cabin Cruises
24.2.a. Balance Payments: Balance payments for cabin cruises are typically made upon arrival in Turkey during check-in. Some charters may require pre-payment. For “arrival payments,” we accept EUR, USD, GBP, AUD, or TRY. Balance payments will be converted using the current xe.com exchange rate on the day of payment.
24.2.b. Currency Exchange Fees: YOURTOURKEY assumes no responsibility for variations in the final transaction amount due to fees and exchange rates applied by banks or other financial institutions.
24.3. Cancellations by Clients:
Clients may cancel their cabin cruise booking with YOURTOURKEY at any time. Cancellations take effect once YOURTOURKEY receives a written request from the Client or Agent. Refunds, if applicable, depend on the timing of the cancellation as follows:
45 days or more before the start date: Refund less 30% of the total product cost.
21 to 45 days before the start date: Refund less 50% of the total product cost.
20 days or less before the start date: No refund.
24.4. Open Date Transfer Policy for Selected Cruises:
24.4.a. If a Client’s circumstances change unexpectedly, they may transfer to an open date option with no additional charges if notice is given at least 21 days before the cruise.
24.4.b. Deposits from the original booking will be transferred to new dates confirmed between the Client and YOURTOURKEY.
24.4.c. Availability of dates is subject to cabin availability, and new prices may apply based on current rates.
24.4.d. This Open Date Transfer Policy applies only to the nine designated cabin routes between Fethiye and Kekova and does not cover routes departing from Bodrum, Marmaris, Antalya, or the Greek Islands.
24.5. No Refunds for Partially Used Services:
No refunds are provided for partially used products or services.
24.6. Cancellation by YOURTOURKEY (Force Majeure):
YOURTOURKEY reserves the right to cancel any confirmed booking due to extraordinary circumstances, such as adverse weather, fire, flight cancellations, or other factors outside OUR control. If cancellation occurs, an alternative product or date will be offered. Transfer costs to new ports will be covered by YOURTOURKEY. If no suitable alternative can be provided, the Client will receive a full refund.
24.7. Accommodation Options for Cabin Cruises:
Products offer two types of accommodation: (a) Shared Cabin Available and (b) Shared Cabin Not Available.
24.7.a. Shared Cabin Available: Options include Double, Twin, Triple, and Quad cabins, with cabin layout and bed types varying by vessel. Due to unforeseen circumstances, specific cabin allocations may change at the last minute.
24.7.b. Shared Cabins Not Available: All cabins feature double beds, and shared options for triples or quads are not available. Solo travelers or groups with odd numbers (3/5/7) must pay a single supplement fee, which may be 70-100% more than the advertised rate based on the season.
24.7.c. Couples and Solo Travelers: Couples may request a private cabin with a double bed (subject to availability). Solo travelers may be assigned to a shared cabin or book a private cabin with a single supplement.
24.8. Complaints for Cabin Cruises:
Complaints during the cruise should first be addressed to the Captain or crew. If unresolved, the Client should notify the YOURTOURKEY office. If a resolution is not reached, written complaints, along with supporting evidence, must be submitted to YOURTOURKEY within 30 days of the product’s completion. Complaints received after 31 days will not be acknowledged.
24.9. Exclusions:
Expenses such as airport taxes, visas, personal insurance, and personal items (e.g., extra beverages, internet access, medical expenses, shopping, or gratuities) are not included unless explicitly stated in the itinerary.
24.10. Vessel Engine Failure or Breakdown:
In the event of a vessel breakdown, YOURTOURKEY has 48 hours to repair the vessel or arrange a replacement. No refunds will be issued under these circumstances. (Refer to Section 24.8 for other complaints.)
24.11. Cabin Charter Guidelines and Regulations:
Each vessel has its own guidelines and regulations, including policies on dietary requirements, air conditioning availability, age limits, and child accommodations. Clients should review each cruise’s specific details before booking. By confirming a booking, Clients accept these conditions.
24.12. Bar Payments and Price Changes:
All bar bills for cabin charters are to be paid in cash. Drink prices may change without prior notice.
24.13. Changes to Cabin Itinerary or Port:
YOURTOURKEY reserves the right to change carriers, itineraries, or ports when unforeseen circumstances arise, always prioritizing the Client’s best interests. In such cases, an alternative will be offered, and any port transfer costs will be covered by YOURTOURKEY. No additional charges or refunds will be applied under these conditions.
25. YOURTOURKEY Travel & Land Tour Products
25.1. Deposit Payments for YOURTOURKEY Turkey Products:
All bookings require a deposit or full payment to confirm. The amount required will be automatically confirmed via our online booking system or by a YOURTOURKEY team member if booked via email.
25.2. Balance Payment for YOURTOURKEY Turkey Products:
25.2.a. Depending on the product, payments may be required either prior to departure or upon arrival. Payment details will be specified on the ticket or itinerary.
25.2.b. For payments made upon arrival, YOURTOURKEY accepts EUR, TRY, USD, GBP, CAD, and AUD, with conversion rates based on xe.com.
25.2.c. Exchange Rate Policy: Payments will be converted using the xe.com exchange rate on the payment day. YOURTOURKEY is not responsible for variations in the final transaction amount due to financial institution fees or exchange rates.
25.3. Cancellations by Clients:
Clients may cancel at any time, with cancellations effective upon written notice to YOURTOURKEY. Refund amounts depend on the timing of the cancellation and third-party costs:
45 days or more: Refund less 30% of the total product cost plus any cancellation fees from third-party services.
21 to 45 days: Refund less 50% of the total product cost plus any third-party cancellation fees.
20 days or less: No refund.
YOURTOURKEY acts as an intermediary for flights, hotels, ferries, and buses; each service has its own cancellation fees, which will be disclosed upon cancellation.
25.4. Open/Alternative Date Transfer Policy:
If the Client provides notice at least 21 days before the product, YOURTOURKEY offers an open date transfer with no fees. All deposits will be transferred to a new date, depending on availability and current pricing. This policy excludes cancellation fees for flights, hotels, ferries, and buses, which will be added to the next booking’s balance.
25.5. Cancellations by YOURTOURKEY:
YOURTOURKEY reserves the right to cancel any confirmed booking at its discretion.
25.6. Product Exclusions:
International flights, airport taxes, customs fees, visas, personal insurance, medical expenses, excess baggage fees, extra meals or beverages outside of the itinerary, entrance fees not specified, and personal items are not included unless listed in the product inclusions.
25.7. Product Changes:
YOURTOURKEY may change carriers, accommodations, or itineraries due to unforeseen circumstances, prioritizing Client interests. No additional charges or refunds apply under these circumstances.
25.8. Complaints Regarding YOURTOURKEY Land Tours and Travel Products:
25.8.a. Complaints should be addressed to YOURTOURKEY staff immediately to allow prompt action.
25.8.b. If unresolved, written complaints should be submitted within 30 days of the product’s completion.
25.8.c. Complaints received 31 days after completion will not be acknowledged.
25.8.d. YOURTOURKEY is not obliged to resolve complaints that were not reported on-site.
25.9. Vessel Engine Failure or Breakdown:
If a vessel in the product experiences a breakdown, YOURTOURKEY has 48 hours to repair or replace the vessel. Refunds are not provided in these cases.
25.10. Guaranteed Departure Products:
Most YOURTOURKEY products are guaranteed to depart as advertised, except when affected by force majeure.
25.11. Minimum Number Requirement for Land Tours:
If a product does not meet the minimum booking requirement, YOURTOURKEY reserves the right to cancel it. Alternatives will be offered, and if no suitable options are available, a full refund will be provided.
25.12. Domestic Flight Luggage Allowance:
Domestic flights included in YOURTOURKEY packages have a 15 kg baggage allowance. Clients are responsible for costs associated with excess baggage.
25.13. Hotel/Airport Transfers:
For independently booked hotels or flights, accurate information must be provided for transfers. Incorrect information may result in loss of liability from YOURTOURKEY.
25.14. Hotel Accommodation:
25.14.a. YOURTOURKEY will choose suitable hotels, and Clients should confirm details upon booking. Any dissatisfaction with accommodation should be raised before itinerary approval.
25.14.b. Hotel complaints should be addressed to the hotel directly, as they are responsible for resolving issues.
25.14.c. Check-in/out times vary by hotel policy, and early/late check-in/out fees are not included.
25.15. Daily Pick-Up & Drop-Off Times:
25.15.a. Pick-up and drop-off times are approximate and may be affected by external factors such as traffic.
25.15.b. Clients will be notified of any changes.
25.15.c. Clients must be punctual, as the product will continue without them if they are late. No refunds will be provided.
25.16. Captain’s Authority and Responsibility:
If the product includes a cruise, Clients are required to follow vessel rules. The Captain has the authority to change itineraries for safety and to terminate the product if necessary.
25.17. Guide and Driver Authority and Responsibility:
Guides and drivers hold authority for Client safety and may modify or terminate the product if safety concerns arise.
25.18. Accuracy of Information:
YOURTOURKEY strives to provide accurate information at publication. However, we are not liable for any inaccuracies contained herein.
